Service/products Agreement (“Agreement”) is made effective as of date of purchase by and between “Client” and Myth Weaver Publications llc (collectively “Parties”).

Premades:
All premades are sold “as-is”. The Designer agrees to change Titles and Author Name, though only minor changes. There are no refunds. All premades will be held up to 1 year after purchase by Myth Weaver Publications llc. No other designer may touch or change any premades sold through Myth Weaver Publications llc.
No premades are to be shared in groups for critiques as no changes are to be made to the design of any premade. All premades will be shown in the online portfolio, including composites of the premade. After a premade is purchased, Author has up to 90 days after the finale changes are approved before we post the cover with their Author Name and Title in our Gallery.
Once you sell more than 500,000 copies of your book, you need to pay $10 for a renewal license on the images used on your cover.
Not for resale. All rights will be striped of Client if Client tries to resale any premades, and reported.

Artwork:
Certain artwork is labeled “free for personal use” and can be used as such including blogs, personal posts, and anything where it’s used in an appropriate manner that doesn’t take away from the artwork, desecrate it, or used to cause emotional damage to another party.
Artwork not labeled “free for personal use” is not to be used without the artist’s expressed permission. If you want it, email us or message us on Facebook and we’ll get you in touch with her.
Not for commercial use!

Renders:
Sold “as is”. Your download link for digital downloads is only good for 24 hours. Please download and save in a safe place after purchase.
Not for resale.
You have full commercial license with each render and effect you purchase to do with what you want except to turn around and sell them as is. You must add them to a project and change them to use commercially. Like on a book cover composite, an ad, anything where you add to it, add it to something, and change it.

Affinity Photo Styles:
Beware - the Affinity Style sets are big files. If you have any issues opening them, please contact us with a screenshot of your purchase and we’ll do our best to make sure you get every style you ordered in a timely manner.
Don’t share files with others, but send them to the site so they can order their own.

Affinity Photo Brushes:
New brushes you can use in Affinity - no file sharing or reselling our brushes. Check back frequently for sales.

Description of Service & Warranties:
Digital purchases - once you purchase a product, you’ll receive a link in your email that’s good for 24 hours. Be sure to download your purchase once you purchase it.
Premades - you have 365 days from date of purchase to change the Title and Author Name. There are no refunds, so be sure to get your cover finished and finalized as soon as possible.

Fees & Expenses:
All transactions will be done through www.mythweaverpublicationsllc.com via PayPal. Please keep a digital copy (don’t delete from your email) for your own taxes and other instances where you need to prove your purchase.
Refunds - there are none.

Taxes:
Myth Weaver Publications llc and Client will each be solely responsible for all federal, state, and local taxes applicable. You’re on your own concerning your own taxes.

Limitation of Purpose:
Outlined in each service/product section in TOS above.
*No resale of bought items that haven’t been changed or used or merged with a design, and no resale of premades.

Client’s Legal Requirements:
It’s the Client’s sole and exclusive responsibility to ensure that all legal requirements for Client’s business are met. Such legal requirements include, but are not limited to, ensuring claims on advertising and graphics are true, accurate, and may be legally stated, as well as ensuring all products are lawful. Neither the Designer nor Myth Weaver Publications llc shall be responsible for any legal, technical, or regulatory specifications.

Confidential or Proprietary Info:
Your personal information won’t be shared. Myth Weaver Publications and Designer agree not to disclose the confidential and/or proprietary info. by any means not authorized by the Client to any third parties; not to disclose the confidential and/or proprietary info. for any purpose except those expressly authorized by the Client; will inform Client immediately if Designer becomes aware of any unauthorized use or disclosure of the confidential and/or proprietary info.

Intellectual Property:
Myth Weaver Publications llc and Designer herby assigns to the Client the right, title, and interest in and to the Works only for the limited purposes as outlined elsewhere in this Agreement.

Portfolio Use:
Myth Weaver Publications llc and Designer shall be permitted to use all Works in Designer’s (and Myth Weaver Publications llc) portfolio. If the client would like Designer to remove their bought Work, then they must contact Myth Weaver Publications llc and let them know. If the Designer agrees, Myth Weaver Publications llc will remove the Work from the portfolio until Client’s Work is public.

Credit:
When giving credit, though none is necessary, cite Myth Weaver Publications llc. As pertaining to signed artwork, don’t cut off the Designer’s signature, is all.

Indemnification:
Myth Weaver Publications llc, Designer, and Client shall each defend, indemnify, and hold the other harmless (including all affiliates, officers, directors, employees, agents, successors, and assigns) from and against all losses, damages, liabilities, deficiencies, actions, judgments, interest, awards, penalties, fines, costs, or expenses of whatever kind (including reasonable attorneys’ fees) arising out of or resulting from bodily injury, death of any person, damage, real or intangible, to personal property resulting from the other’s acts or omissions or the breach of any representation, warranty, or obligation under this Agreement.

Governing Law:
This Agreement shall be governed by and construed in accordance with the internal laws of Colorado without giving effect to any choice or conflict of law provision or rule. Each party irrevocably submits to the exclusive jurisdiction and venue of the federal and state courts located in El Paso County in any legal suit, action, or proceeding arising out of or based upon this Agreement or the Works provided hereunder.

Benefit:
This Agreement shall be binding upon and shall inure to the benefit of each of the parties hereto, and to their respective heirs, representatives, successors, and assigns.

Notices:
All notices, requests, consents, claims, demands, waivers and other communications hereunder (each, a “Notice”) shall be digital and addressed to the Parties. All notices shall be delivered by email when possible or at the address which the parties may designate to each other through personal delivery, nationally recognized overnight courier (with all fees prepaid), or certified or registered mail (in each case, return receipt requested, postage prepaid). Except as otherwise provided in this Agreement, a Notice is effective only if (a) the receiving party has received the Notice and (b) the party giving the Notice has complied with the requirements of this Section.

Force Majeure:
Myth Weaver Publications llc is not liable for any failure to perform due to causes beyond its reasonable control including, but not limited to, acts of God, acts of civil authorities, acts of military authorities, riots, embargoes, acts of nature and natural disasters, and other acts which may be due to unforeseen circumstances.

Headings:
Headings to this Agreement are for convenience only. Headings shall in no way affect the provisions themselves and shall not be construed in any way that would limit or otherwise affect the terms of this Agreement.

Entire Agreement; Modification:
Terms of Services may be changed or modified by Myth Weaver Publications llc. Please take note and look through the Terms of Service carefully.

By purchasing products/services from Myth Weaver Publications llc, you hereby agree to all terms and conditions.
